Terms of Service

These Terms of Service ("Terms") are an agreement between you and Solarfunnels Inc., a Wyoming corporation, doing business as Attimo ("Attimo", "we", "us", "our"). They govern your use of attimo.ai, our forms and booking page, the Janice AI voice demo, and the calls, text messages and emails we send you (together, the "Site"). Our Privacy Policy explains how we handle personal information and is part of these Terms.

Please read Disputes and arbitration carefully. It requires most disputes to be resolved by individual binding arbitration instead of in court, and waives class actions and jury trials, unless you opt out within 30 days as described there.

By using the Site, submitting a form, booking a call or starting the voice demo, you agree to these Terms. If you do not agree, do not use the Site.

Who may use the Site

You must be at least 18 years old and able to form a binding contract. Attimo is a service for businesses. If you use the Site on behalf of a company, you confirm that you are authorized to act for it, and "you" includes that company.

Our services

Attimo designs, builds and runs AI appointment setters that contact a business's leads by phone, text and email, answer questions, and book appointments. The Site describes our services and lets you try them. Any paid service is provided only under a separate written agreement signed by both of us. If that agreement conflicts with these Terms, the agreement controls. Nothing on the Site is an offer that binds us until that agreement is signed.

Artificial intelligence

• You are talking to an AI. Janice, the voice demo and many of our calls and texts are powered by artificial intelligence and use an artificial voice. You can ask for a person at any time.
• AI can make mistakes. AI output may be inaccurate, incomplete or out of date. Do not rely on it as legal, financial, tax, compliance or other professional advice.
• Not a commitment. Nothing the AI says creates a contract, a price, a guarantee, a discount or any other obligation. Only a signed agreement does.
• Recording. Voice demo conversations are processed by our AI providers and transcribed, and calls with us may be recorded and transcribed, as described in our Privacy Policy. By starting the demo or staying on a call, you consent to this.

Voice demo rules

We invite you to test Janice with hard questions and objections. That is what the demo is for. To keep it available for everyone, you agree not to:

• Use bots, scripts or automated tools to start or run sessions, or try to get around session limits, geographic limits or other safeguards.
• Try to access our systems, keys, prompts or data without authorization, or interfere with the demo, the AI provider or other users.
• Say or submit anything unlawful, threatening, harassing, hateful or sexually explicit, or anything that infringes someone else's rights.
• Give someone else's name, phone number or email, or book a meeting in someone else's name, without their permission.
• Use the demo or its output to build or train a competing product.

Demo sessions are limited in length and number, and may be ended or unavailable at any time.

Call requests and consent

When you submit a call request form, you agree that Attimo (Solarfunnels Inc.) may call you at the number you provide about your request and our services, including follow-up calls made with automated technology and an AI voice. Calls may be recorded. Consent is not a condition of purchasing any goods or services.

You confirm that the phone number you submit is yours or that you are authorized to use it and to give this consent, and you agree to tell us if that number changes owner. We place automated calls only between 8 a.m. and 9 p.m. in your local time. Any timing described on the Site, such as how soon we call, applies within those hours and is a goal, not a guarantee.

Text messaging program

Program. The Attimo text messaging program, operated by Solarfunnels Inc., sends automated text messages about your request and appointments, such as follow-up on a form you submitted, booking confirmations, appointment reminders, replies to your questions, and information about our services.

Opting in. You join by ticking the optional text message box on one of our forms, or by giving consent when you book a call. The box is never pre-ticked, and consent is not a condition of purchase.

• Message frequency varies with your request and replies.
• Message and data rates may apply. Contact your wireless carrier for details about your plan.
• Reply STOP to any message to cancel. You will receive one message confirming that you have been unsubscribed and no further texts unless you opt in again. You can also opt out by any other reasonable means, such as telling us on a call or emailing [email protected].
• Reply HELP for help, or contact us at [email protected] or (949) 849-4104.
• Carriers are not liable for delayed or undelivered messages.
• We do not share mobile opt-in data or consent with third parties. See our Privacy Policy.

Stopping calls and texts

You can revoke consent to calls and texts at any time and by any reasonable means, including replying STOP, telling us during a call, calling (949) 849-4104, or emailing [email protected]. We honor requests promptly and within the time the law requires, and we keep a record of your request so we continue to honor it.

For businesses that use Attimo

When Attimo contacts leads on behalf of a client, the client's agreement with us governs, and the client is responsible for its leads and its marketing. Among other things, the client is responsible for obtaining and keeping all consents required to call and text its leads, including prior express written consent for AI voice and automated calls and texts where required; for honoring opt-outs and do-not-call requests; for the accuracy of the information and offers it gives us; and for complying with the Telephone Consumer Protection Act, the Telemarketing Sales Rule, state telemarketing and privacy laws, and carrier rules. We may pause or refuse any campaign we believe does not comply.

Results and testimonials

Statistics, case studies and examples on the Site describe results from specific clients and campaigns. They are not typical and are not a promise of what you will achieve. Results depend on your market, lead sources, offer, pricing, sales process, response to booked appointments and many other factors outside our control. We do not guarantee any number of contacts, appointments, sales or revenue.

Acceptable use

In addition to the voice demo rules, you agree not to submit false information or another person's details, send spam through our forms, probe, scan or test the vulnerability of our systems, copy or scrape the Site, use it to violate any law, or help anyone else do these things. We may block, suspend or refuse access to anyone who misuses the Site.

Our content and your feedback

The Site, including its text, design, graphics, logos, scripts and software, is owned by Solarfunnels Inc. or its licensors and protected by intellectual property laws. We give you a limited, revocable, non-exclusive right to view the Site for your own evaluation of our services. Attimo and our logo are our trademarks. Other names and logos, including Google, Meta, Facebook, Instagram, TikTok and OpenAI, belong to their owners, and their mention does not mean they endorse us. If you send us ideas or feedback, we may use them without any obligation to you.

Third-party services

The Site relies on and links to services run by others, such as our hosting, AI, telephone, analytics and advertising providers. Those services have their own terms and privacy policies, and we are not responsible for them or for sites we link to.

Disclaimers

The Site, the voice demo and all content and AI output are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy, and any warranty that the Site will be uninterrupted, secure or error free.

Limitation of liability

To the fullest extent the law allows, Attimo, Solarfunnels Inc. and their officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Site or these Terms, even if advised of the possibility. Our total liability for all claims arising from or related to the Site or these Terms is limited to one hundred U.S. dollars.

Some states do not allow certain limits on warranties or liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law. Liability for paid services is governed by the client agreement.

Indemnification

You agree to defend, indemnify and hold harmless Solarfunnels Inc. and its officers, employees and contractors from claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the Site, your violation of these Terms or the law, or information you submit, including a phone number you were not authorized to submit.

Disputes and arbitration

Talk to us first. Before starting any claim, send a written notice describing the dispute and the relief you want to [email protected] and 30 N Gould St, Sheridan, WY 82801. We will do the same. If we cannot resolve it within 60 days, either of us may start arbitration.

Binding individual arbitration. Except as stated below, any dispute, claim or controversy arising from or relating to the Site, these Terms, or any call, text or email between us, including claims under the Telephone Consumer Protection Act or similar laws and questions about the scope of this section, will be resolved by binding arbitration administered by the American Arbitration Association under its applicable rules, before a single arbitrator. The Federal Arbitration Act governs this section. The arbitration may be held by video or phone, or in the county where you live. Each side pays its own attorneys' fees unless the arbitrator awards them under applicable law, and we will pay filing and arbitrator fees above what you would pay to file in court.

Class action and jury trial waiver. You and Attimo may bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not consolidate claims or award relief to anyone other than the individual party. You and Attimo waive any right to a jury trial.

Exceptions. Either of us may bring an individual claim in small claims court, and either of us may ask a court for an injunction to stop infringement or misuse of intellectual property or systems.

Opting out. You may opt out of this arbitration section by emailing [email protected] within 30 days after you first accept these Terms, with your name, phone number and a statement that you opt out of arbitration. Opting out does not affect the rest of these Terms.

If this section does not apply. If the class action waiver is found unenforceable for a claim, that claim must be decided in court and not in arbitration. Any claim that is not arbitrated will be brought only in the state or federal courts located in Sheridan County, Wyoming, and both of us consent to their jurisdiction.

Governing law

These Terms are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict of law rules.

Changes to these Terms

We may update these Terms from time to time. The date at the top shows when they last changed. Changes apply from that date to your later use of the Site. Changes to the arbitration section will not apply to a dispute we already knew about.

General

These Terms, with the Privacy Policy and any signed client agreement, are the entire agreement between us about the Site. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. We are not responsible for delays caused by events beyond our reasonable control. You agree that we may give you notices electronically, and that electronic agreements and consents are as valid as signed paper ones.
